1. Acceptance of Terms
By subscribing to FloatHeavy's web design service, you ("Client," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, do not use our service.
These Terms constitute a binding agreement between you and FloatHeavy ("we," "us," "our"). By submitting a subscription request, providing content for your website, or making a payment, you confirm your acceptance.
2. Description of Service
FloatHeavy provides a web design subscription service for local service businesses. Our standard service includes:
- A custom-designed, hand-coded 5-page website (Home, Services, About, Contact, plus one additional page)
- Mobile-optimized, responsive design
- SEO fundamentals (meta tags, page structure, site speed optimization)
- SSL certificate (HTTPS) included
- Contact form with email notifications
- Website hosting on Cloudflare Pages
- Ongoing content changes (text, images, hours, phone number updates) included in your subscription
3. Subscription and Payment
The FloatHeavy subscription costs $199 per month. Here is how billing works:
- No upfront payment. Your first payment is charged when your website goes live, not before.
- Monthly auto-renewal. Your subscription automatically renews each month. Payment is processed via credit card on the same day each month.
- Month-to-month. There are no long-term contracts. You are billed monthly and can cancel at any time per the cancellation terms below.
- Failed payments. If a payment fails, we will attempt to process it again and notify you. If payment is not resolved within 7 days, we reserve the right to suspend your website until the balance is current.
- Price changes. We will provide at least 30 days' written notice before any changes to pricing. Your current rate is locked in until we notify you otherwise.
4. Cancellation
You may cancel your subscription at any time by providing 30 days' written notice via email to hello@floatheavy.com.
- What happens when you cancel. Your website will remain live through the end of your final billing cycle. After that, hosting will be discontinued and your site will go offline.
- Site files after 12 months. If you have been a subscriber for 12 months or more, you may request a copy of your website files upon cancellation. We will provide the HTML, CSS, and image files that make up your site.
- Site files before 12 months. If you cancel before completing 12 months of service, FloatHeavy retains ownership of the website design and code. You retain ownership of all content you provided (see Section 5).
- Your domain. Your domain name is always yours. We will assist with any DNS changes needed during the transition at no extra charge.
- No refunds. Subscription payments are non-refundable. Cancellation takes effect at the end of the current billing period.
5. Content Ownership
- Your content. You retain full ownership of all content you provide, including text, images, logos, and branding materials. We do not claim ownership of your content at any point.
- Website design and code. FloatHeavy owns the website design, code, and technical implementation during the first 12 months of your subscription. After 12 consecutive months of paid service, ownership of the site files transfers to you.
- Your domain. Your domain name is your property at all times, regardless of subscription status.
6. Content Responsibilities
You are responsible for the content displayed on your website. By providing content to FloatHeavy, you represent and warrant that:
- All information you provide is accurate and truthful.
- You have the right to use all text, images, logos, and other materials you provide.
- Your content does not infringe on any third party's intellectual property rights, trademarks, or copyrights.
- Your content does not contain anything unlawful, defamatory, obscene, or otherwise objectionable.
- Your business complies with all applicable local, state, and federal laws.
FloatHeavy reserves the right to refuse to publish content that violates these requirements.
7. Changes and Updates
Content changes are included in your subscription at no additional cost. Here is what that covers:
- What counts as a change. Updates to text, images, phone numbers, business hours, staff bios, service descriptions, and similar content modifications.
- How to request changes. Send an email to updates@floatheavy.com with the details of what you need changed.
- Turnaround time. Changes are typically completed within 48 business hours of receiving your request.
- What is not a change. Adding entirely new pages, redesigning the site layout, building new functionality (e-commerce, booking systems, member portals), or substantially restructuring the site. These fall outside the standard subscription and would be quoted separately.
8. Hosting and Uptime
Your website is hosted on Cloudflare Pages, a globally distributed platform known for speed and reliability.
- Uptime. We make every reasonable effort to keep your site available 24/7. However, we do not guarantee a specific uptime percentage or provide a formal Service Level Agreement (SLA).
- Downtime. Occasional downtime may occur due to infrastructure maintenance, Cloudflare platform issues, or other factors beyond our control. We are not liable for any losses resulting from temporary unavailability of your website.
- Security. SSL certificates are included and automatically managed. Cloudflare provides DDoS protection and CDN caching as part of their platform.
9. Intellectual Property and Portfolio Use
FloatHeavy retains the right to display your completed website in our portfolio, case studies, and marketing materials. This includes screenshots, descriptions of the project, and links to the live site.
- Opt-out. If you do not want your website featured in our portfolio, notify us in writing at hello@floatheavy.com and we will remove it within 7 business days.
- Your trademarks. Use of your business name and logo in our portfolio does not transfer any trademark rights to FloatHeavy.
10. Limitation of Liability
To the maximum extent permitted by law, FloatHeavy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from or related to your use of our service.
Our total liability for any claim arising out of or related to these Terms or our service shall not exceed the total amount you have paid to FloatHeavy in the three (3) months immediately preceding the event giving rise to the claim.
We are not responsible for:
- Loss of business or revenue due to website downtime
- Errors in content provided by you
- Third-party service outages (hosting infrastructure, domain registrars, email providers)
- Results of search engine rankings or marketing performance
- Actions taken by visitors to your website
11. Indemnification
You agree to indemnify, defend, and hold harmless FloatHeavy and its owners, employees, and contractors from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms
- Content you provide for your website
- Your use of the website or service
- Any third-party claims related to your business, services, or website content
- Your violation of any applicable law or regulation
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our service shall be resolved in the state or federal courts located in Washington State.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will:
- Provide at least 30 days' notice via email before changes take effect
- Update the "Last updated" date at the top of this page
- Post the revised Terms on this page
Your continued use of the service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you may cancel your subscription per Section 4.
